Terms of Use
These Terms of Use (“Terms”) are an agreement between you and withJZ LLC, a Wyoming (USA) limited liability company (“withJZ”, “we”, “us”, “our”). They cover all services and experiments withJZ LLC operates under mybigexperiment.com, including the “withJZ Crew” AI assistants (“the Services”).
1. Accepting these Terms
- By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
- Our Privacy Policy explains how we handle personal data. Please read it.
- If you use the Services on behalf of an organization, you confirm that you are authorized to accept these Terms for it. In that case, “you” includes that organization.
2. Invite-only access
- The Services are invite-only. They are not offered to the general public.
- Your invitation is for you. Do not share it or your access with anyone else.
- We may revoke your access at any time, for any reason, with or without notice.
3. Who can use the Services
- You must be at least 18 years old, or be authorized by your organization to use the Services for its work.
- The Services are not for anyone under 16.
4. Your account and credentials
- Keep your password and other credentials secure. Do not share them.
- You are responsible for activity under your account.
- If you think someone has used your account without permission, tell us right away at security@mybigexperiment.com.
5. Acceptable use
When you use the Services, do not:
- do anything unlawful, or help anyone else break the law;
- harass, threaten, or abuse anyone;
- upload, run, or spread malware or other harmful code;
- probe, scan, or test the security of the Services, or try to bypass security measures, sandboxes, access controls, or rate limits;
- try to access or extract other users’ data;
- upload content you do not have the right to share. This includes confidential information belonging to your employer or clients that you are not authorized to share;
- send special categories of personal data, such as health, genetic, or biometric data, unless your Workspace Operator permits it. A “Workspace Operator” is an organization or person that runs its own workspace on the Services.
If you find a security problem, report it to security@mybigexperiment.com instead of testing it further.
We may remove content, or suspend access, that breaks these rules.
6. Your content
- Your content stays yours. “Your content” means the messages, files, images, and links you send to the Services.
- The license you give us. You grant withJZ LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, and process your content. We use this license only to provide the Services, including keeping them secure and working, and sending your content to the chat platforms and AI providers your workspace uses.
- When the license ends. The license ends when your content is deleted, as described in our Privacy Policy.
- No training. We do not use your content to train AI models.
- Replies. We do not claim ownership of the replies the assistants generate for you.
- Your responsibility. You are responsible for your content and for having the right to share it.
7. AI output
- The assistants use AI models. Their output can be inaccurate, incomplete, out of date, or inappropriate, even when it sounds confident.
- Check important information before you rely on it.
- Output is not legal, financial, medical, or other professional advice.
- You are responsible for how you use output, including any actions you ask an assistant to take.
8. Experiments can change or stop
- The Services are experiments. We may change, pause, or stop any part of them at any time, without notice.
- We do not promise any level of availability, uptime, support, or response time. There is no service level agreement (SLA).
- Keep your own copies of anything important.
9. Third-party services
- The Services work with third-party services, such as Slack, Microsoft Teams, and AI model providers.
- Those services have their own terms and privacy policies, including the AI providers’ usage policies. Those terms apply to your use of them.
- We do not control third-party services and are not responsible for them.
- If a Workspace Operator connects services using its own accounts, its agreements with those providers apply. The Workspace Operator is responsible for following them.
10. Feedback
If you send us ideas, suggestions, or other feedback, we may use it freely, for any purpose, without any obligation to you.
11. Privacy
Our Privacy Policy explains what personal data we collect, how we use it, and your rights.
12. Suspension and termination
- We may suspend or end your access at any time. For example, we may do this if we believe you broke these Terms, to protect the Services or other users, or because an experiment ends.
- You can stop using the Services at any time. You can also ask us to delete your data, as described in our Privacy Policy.
- Sections that by their nature should continue after your access ends will continue. These include sections 6 (until your content is deleted), 10, and 13 to 18.
13. Disclaimer of warranties
To the extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Services will be uninterrupted, secure, or error-free.
14. Limitation of liability
To the extent permitted by law:
- withJZ LLC is not liable for any indirect, incidental, special, consequential, or punitive damages. This includes loss of profits, revenue, data, or goodwill arising from or related to the Services or these Terms.
- withJZ LLC’s total liability for all claims arising from or related to the Services or these Terms is limited to USD 100 in aggregate.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless withJZ LLC from any claims, losses, and costs, including reasonable legal fees, that arise from your misuse of the Services or your breach of these Terms.
16. Governing law and disputes
- These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules.
- Any dispute will be decided by the state or federal courts located in Wyoming. You and we agree to their jurisdiction.
- Your local consumer rights. Nothing in these Terms limits mandatory consumer protection rights you have under the law of the country where you live. For example, if you are a consumer in the European Union, you keep the protection of the mandatory laws of your country, and you may be able to bring a claim in the courts where you live.
17. Changes to these Terms
- We may update these Terms. When we do, we change the “Last updated” date at the top and add a note under What changed.
- For material changes, we also notify active users in the chat apps or by email.
- If you keep using the Services after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Services.
18. General
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect. The unenforceable part is applied to the greatest extent the law allows.
- Separate agreements. If you or your organization has a separate written agreement with withJZ LLC about the Services, that agreement controls where it conflicts with these Terms.
